WHAT INFORMATION DO WE COLLECT?

We collect information when you visit our sites, fill out a form or access an online service we provide.  

You may be asked to enter certain “Personal Information” such as your name, e-mail address, mailing address, phone number, login name and password, as appropriate. The submission of Personal Information is purely voluntary, but it may be a necessary step for registering or participating in certain activities offered or made available through our site or online services. By providing Personal Information, you consent to the collection and use of the Personal Information by BMI for the purpose for which it was provided and as stated herein. 

If you are under 18 years of age or the age of majority in your state of residence, please do not submit Personal Information to our site or online services for any purpose. We do not intentionally collect Personal Information from minors.  

DO WE USE COOKIES OR AUTOMATIC DATA COLLECTION TECHNOLOGIES? 

Yes. We use “cookies.” Cookies are small files transferred to your computer’s hard drive through your web browser (if you allow them) that enable us to recognize your web browser and capture and remember certain information such as customer number, an IP (“URL”) address, a processor or serial number, or other unique identifier to provide information about your computer equipment, browsing actions and website usage. 

We may use other automatic data collection technologies such as web “beacons.” Web beacons are small, transparent graphic images (such as clear GIFs, pixel tags and single pixel GIFs) placed on website pages and advertisements for use in combination with cookies to collect website statistics (browser type, operating system, web pages, language, IP, time and location of IP) to compile non-personal aggregate data about site traffic and site interaction and recognize a user’s activities over time and across difference websites and services.  

Some content, features, advertisements and applications on our non-BMI Imaging Systems hosting websites or online services may be served by or linked to third parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about users to our websites and online services. The information they collect may be associated with Personal Information (as authorized by you) or they may collect information, including Personal Information (as authorized by you), about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.  

BMI Imaging Systems’ hosting website or online services may use third parties to provide outside of BMI perimeter security programs like Web Application Firewalls, WAF. These third parties may use tracking and traffic inspection technologies to provide filtering and monitoring of Internet Traffic before reaching BMI Imaging Systems. 

DO-NOT-TRACK DISCLOSURES

BMI uses the information collected through cookies and automated data collection technologies (alone or in conjunction with Personal Information) to make the company websites and related online services more useful and more personal to users and their individual interests. Therefore, we do not respond to “do not track” requests.  

You may refuse to accept browser cookies by activating the appropriate setting on your Internet browser or by using third party do not track technologies. However, if you refuse, disable or delete cookies from our websites or related online services (including mobile applications), certain parts or features of our company websites or online services may be inaccessible or not functional. 

Unless you adjust your web browser settings so that it will refuse cookies or you use third party technology to refuse, disable or delete cookies or other automated data collection technologies, your use of BMI websites or online services constitutes consent to the use of automated data collection technologies in connection with company sites and related online services. 

However, we honor the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sharing of your Personal Information for cross-context behavioral advertising. WHAT DO WE USE YOUR INFORMATION FOR? 

Any of the Personal Information we collect from you may be used in one of the following ways:  

  • To personalize your experience (your information helps us to better respond to your individual needs); To improve our website or online services (we continually strive to improve our website offerings based on the information and feedback we receive from you);  
  • To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs);  
  • To send periodic emails for the purpose for which it was provided and to send you information and updates pertaining to our site and services. 
  • Perform administrative and business reporting

  • Respond to inquiries and fulfil requests made by you

  • To provide Security functions like IP restrictions 

If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, related product or service information, etc.  

DO WE DISCLOSE ANY INFORMATION TO OUTSIDE PARTIES? 

We do not sell or rent your Personal Information to third parties. We may share your Personal Information in the following circumstances:

Service providers. We share Personal Information with trusted third-party service providers who perform functions on our behalf, including website hosting, customer relationship management, email delivery, analytics, advertising measurement, and payment processing. These service providers are contractually obligated to use the Personal Information only for the purposes for which it was disclosed and to maintain appropriate safeguards.

Analytics and advertising partners. We use third-party analytics and advertising services, including Google Analytics and Google Ads, to measure how visitors use our website and to evaluate the effectiveness of our marketing. As part of conversion tracking — including Google Ads Enhanced Conversions — we may share hashed (cryptographically encoded) versions of identifiers such as your email address with Google so that Google can attribute conversions to advertising campaigns. The information shared in this way cannot be used by Google to identify you unless Google already holds matching information from another source. We do not provide Google with the underlying plain-text identifiers, the contents of any form submission, or any details about your inquiry.

Legal and protective disclosures. We may release Personal Information when we believe release is appropriate to comply with the law, respond to lawful requests from public authorities, enforce our site policies, or protect the rights, property, or safety of BMI, our customers, or others.

Aggregated or de-identified information. We may share aggregated or de-identified information that cannot reasonably be used to identify you for marketing, advertising, research, or other lawful purposes.

HOW TO UNSUBSCRIBE, ACCESS, CORRECT, OR DELETE YOUR PERSONAL INFORMATION

If at any time you would like to unsubscribe from receiving future emails, you may send a request to security@bmiimaging.com. Instructions to unsubscribe may also be found in our emails.

You may also request to access, correct, or delete the Personal Information we hold about you by emailing security@bmiimaging.com. We will acknowledge receipt of your request within ten (10) business days and will respond substantively within forty-five (45) days, with one possible extension where reasonably necessary. Before fulfilling certain requests, we may need to verify your identity by asking you to confirm information already on file. Deletion of Personal Information from readily accessible records may cause certain features or services to be unavailable or not function properly. Even after a deletion request is processed, Personal Information may be retained in archival business records as required by law and for internal business purposes only (for example, retrieval of service usage and billing history).

California residents and residents of certain other states may have additional rights described in the “Your California Privacy Rights” section below.

YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with specific rights regarding your Personal Information. This section describes those rights and how to exercise them.

Categories of Personal Information We Collect. In the preceding twelve (12) months, BMI has collected the following categories of Personal Information about California consumers: identifiers (such as name, email address, mailing address, phone number, IP address, and online identifiers); commercial information (such as records of products or services purchased or considered); internet or other electronic network activity information (such as browsing history and information regarding interaction with our website); general geolocation data derived from IP address; professional or employment-related information (when relevant to a business inquiry); and inferences drawn from any of the above to create a profile reflecting preferences and characteristics. We do not knowingly collect sensitive personal information as defined under the CCPA from website visitors.

Sources of Personal Information. We collect this information directly from you, automatically through your use of our website (cookies, web beacons, log files), and from service providers who help us operate our business.

Business and Commercial Purposes. We use Personal Information to provide and improve our services, respond to inquiries, fulfill orders, conduct marketing and advertising, measure the effectiveness of our marketing, comply with legal obligations, and protect against fraud and unauthorized activity.

Categories of Third Parties. We may share Personal Information with service providers (hosting, analytics, advertising, email, CRM, payment); advertising and analytics partners (such as Google); professional advisors; and government authorities or other parties when required by law.

Sale or Sharing of Personal Information. BMI does not sell Personal Information for monetary consideration. However, our use of advertising and analytics cookies — including Google Ads conversion tracking and Enhanced Conversions — may constitute “sharing” of Personal Information for cross-context behavioral advertising under the CCPA. You have the right to opt out of this sharing.

Your Rights. Subject to certain limits, California residents have the right to: know what Personal Information we collect, use, disclose, and share; request a copy of the specific Personal Information we have collected about you; correct inaccurate Personal Information; delete Personal Information we have collected from you; opt out of the sale or sharing of Personal Information; limit the use and disclosure of sensitive Personal Information (where applicable); and be free from retaliation or discrimination for exercising these rights.

How to Exercise Your Rights. To submit a request, email security@bmiimaging.com with the subject line “California Privacy Request” and include enough information for us to verify your identity and locate your records. You may also use the “Do Not Sell or Share My Personal Information” link to opt out of sharing for advertising purposes. We will respond to verifiable requests as required by law.

Authorized Agents. You may designate an authorized agent to make a request on your behalf. We will require written authorization from you and verification of the agent’s identity before processing the request.

Global Privacy Control. We honor the Global Privacy Control (GPC) browser signal as a valid request to opt out of the sharing of your Personal Information for cross-context behavioral advertising on our website.

VISITOR COMMENTS AND SUBMISSIONS  

Our web sites and online services may allow the ability to post comments, information about yourself and others, and to upload media content (“Submissions”). Submissions are voluntary and must be non-confidential and non-proprietary, and you agree that BMI is free to use or not use your Submissions for any purpose without acknowledgement, attribution or payment to you or anyone else. 

SOCIAL MEDIA ONLINE SERVICES  

We may participate in the use of third-party social media web sites and services such as Facebook, Twitter, and YouTube. The use of such web sites is subject to the Terms of Service of each respective web site or service. In addition, information you submit through social media sites and services is subject to the privacy policy of each site and service. BMI has no control or responsibility for the security, privacy or use of information submitted to these sites or services that are unrelated to BMI activities. You should carefully review the terms and conditions, and privacy policy, of any other site or service provider before using their site or service. Any information we collect through the intermediary use of such sites or services, such as information submitted for contests or prizes, is subject to this Privacy Statement. 

MOBILE DEVICE AND WIRELESS NETWORK SECURITY  

Mobile devices such as cell phones and other devices using Wi-Fi networks can have financial and other information intercepted during use. It is important to use only encrypted transmissions on secured Wi-Fi networks when transmitting Personal Information to BMI. In addition, passwords and other login information should be stored in password protected files in case a mobile device is lost or stolen. 

DATA SECURITY  

BMI uses appropriate physical, electronic and managerial procedures to safeguard and protect Personal Information from unauthorized access, use and disclosure. We use Secure Socket Layer (SSL) encryption technology for the transmission of Personal Information. To take advantage of this technology, your browser software must support 128- bit encryption. 

YOUR RESPONSIBILITY 

You must also take precautions to prevent unauthorized access and use of Personal Information including login names and passwords. You must keep it secret and not allow others to use your personal passwords or other Personal Information used to access and/or conduct transactions on this site or any BMI online service. You are solely responsible for all results (claims, liabilities and damages of any kind) arising from or related to your disclosure of Personal Information to another person or entity, whether the disclosure was intentional or not. You agree not to use anyone else’s personal identification information without proper authorization. 

VISITOR’S RISK AND LIMITATION OF COMPANY’S LIABILITY FOR FAILURE OF SECURITY MEASURES  

Due to the nature of electronic communications and storage, the BMI’s security measures may not prevent all loss, misuse, theft or alteration of Personal Information collected from the site. THEREFORE, THE VOLUNTARY SUBMISSION OF PERSONAL IDENTIFICATION INFORMATION VIA THIS SITE IS AT THE VISITOR’S SOLE RISK AND, EXCEPT AS PROHIBITED BY LAW, EACH VISITOR AGREES THAT BMI AND IT AFFILIATES SHALL NOT BE LIABLE FOR ANY FAILURE OF SECURITY MEASURES OR FOR ANY UNAUTHORIZED ACCESS, USE, DISTRIBUTION, ALTERATION OR THEFT OF PERSONAL INFORMATION ARISING FROM OR  RELATED TO THE SUBMISSION OF PERSONAL INFORMATION VIA A BMI COMPANY SITE OR ONLINE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BMI OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO ANY FAILURE OF SECURITY MEASURES OR ANY UNAUTHORIZED ACCESS, USE, DISTRIBUTION, ALTERATION OR THEFT OF PERSONAL INFORMATION.  

TERMINATION OR SUSPENSION OF ACCESS / PARTICIPATION  

BMI reserves the right to suspend or terminate access or participation in any and all sites, services, transactions, or other activity offered or made available through a BMI company site or online service in the event of a suspected or threatened breach of security or the terms of this Privacy Statement. 

ONLINE PRIVACY STATEMENT ONLY  

This online Privacy Statement applies only to information collected through our website and not to information collected offline or through a third-party site or service. 

HOW LONG WE KEEP INFORMATION 

We keep information for as long as it is necessary to fulfil the purpose for which it was collected, unless we are required to keep it for longer to comply with our legal obligations, resolve disputes, protect our assets, or enforce our rights.
